Refund policy

The General Terms and Conditions of Resort Finest BV apply to all agreements between the Customer and Resort Finest BV, as well as their execution via the Resort Finest BV website.


Under General Terms and Conditions are understood:


  1. Resort Finest BV, also referred to as Resort Finest in the following document.
  2. Customer: the natural person who, not acting in the exercise of profession or business, purchases or repairs products and/or services from Resort Finest as a customer.
  3. Cardholder: the natural person who, not acting in the exercise of profession or business, purchases or repairs products and/or services from Resort Finest as a cardholder.
  4. Products and/or services: products and/or services in the field of (women's) fashion and lifestyle and other (related) items, as far as these are sold by Resort Finest.
  5. Agreement: the purchase concerning products and/or services of Resort Finest which is concluded at the moment of acceptance by the Customer of the offer and meeting the conditions set forth.

  1. Resort Finest ensures that the products and/or services comply with the agreement, the specifications stated in the offer, and possess the properties necessary for normal use and, if agreed, special use.
  2. If an offer has a limited duration or is made under conditions, this will be explicitly stated in the offer.
  3. Every offer is subject to obvious typographical, typesetting, or programming errors and available stock. The customer has the duty to immediately report inaccuracies in provided or stated data to Resort Finest.

Payment

  1. When prepayment is agreed upon, up to a maximum of 50% of the purchase amount, the customer cannot derive any rights from the execution of the respective agreement or the relevant request for the provision of service(s) until the stipulated advance payment has been made.

  1. Resort Finest is entitled to charge statutory interest for late payment by the customer, calculated from the day the default commences, after written notice of default, until the day of payment. Any extrajudicial collection costs incurred by Resort Finest are for the customer's account.
  2. Resort Finest can – within legal frameworks – determine whether the customer can meet their payment obligations, as well as all facts and factors important for responsibly entering into the agreement. If Resort Finest based on this investigation has good grounds not to enter into the agreement, Resort Finest is entitled to refuse an order or application motivated or to attach special conditions to its execution.

Prices

  1. The prices mentioned in the offer of products and/or services are in Euros (€), including VAT, excluding shipping costs.

  1. During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for price changes resulting from changes in VAT rates.

Deliveries

  1. Delivery is deemed to have taken place at the moment Resort Finest gives the purchased product into the possession of the customer.

  1. After delivery, the risk of damage and/or loss of products passes to the Customer.
  2. Resort Finest is not obliged to compensate any damage incurred by the customer in case of force majeure.
  3. If the Agreement is concluded on the website of Resort Finest, the General Terms and Conditions are available for inspection on the respective website.

Method of Payment

  1. The amount owed to Resort Finest must be paid immediately upon placing the order, unless otherwise agreed.

  1. If the agreement is concluded electronically, the text of these general terms and conditions will be made available electronically to the customer in such a way that it can be stored on a durable medium and printed out easily by the customer.
  2. The agreement is concluded when Resort Finest confirms the customer's order by email.
  3. Orders accepted by Resort Finest are sent to the customer in order of receipt and will be executed within 30 (thirty) days if no longer delivery term is agreed. If the delivery is delayed, or if an order cannot or only partially be executed, the customer will be informed at the latest one month after placing the order. Resort Finest then has the right to cancel the order without costs and refund any prepaid amount.

Reflection Period

  1. When purchasing products, the customer has the option to dissolve the agreement without giving any reason or to exchange the purchased products within 30 (thirty) days, starting the day after the customer or a designated third party receives the product.

  1. During this period, the customer will handle the product and packaging carefully. The customer will only unpack or use the product to the extent necessary to determine whether they wish to keep the product. If they make use of their right of withdrawal, they will return the product with all accessories supplied and, if reasonably possible, in the original condition and packaging to Resort Finest, following the reasonable and clear instructions provided by Resort Finest.
  2. If the customer makes use of their right of withdrawal and returns the products to Resort Finest, the (possible) shipping costs (this refers to the costs from the warehouse/warehouse to the customer) will be refunded. The cost of returning is for the customer's account.
  3. Returns can be made through the applicable return procedure. This can be found on our website.

Returns

  1. Unless otherwise agreed, the customer has the right to return the purchased product within 30 days of the delivery date of the purchased product upon presentation of the original purchase receipt.

  1. The right to exchange is in accordance with the conditions in the "Inspection Period" article of the General Terms and Conditions.
  2. If the customer has paid an amount, Resort Finest will refund this amount as soon as possible, but no later than within 14 (fourteen) days after receiving the return or withdrawal.
  3. The right of withdrawal does not apply to the sale or purchase of goods that have been created according to the customer's specifications, i.e., specially custom-made, or which are explicitly stated as non-exchangeable.


Delivery Address, Delivery Times, and Address Changes

  1. The delivery address is the address that the customer has provided to Resort Finest.

  1. Orders placed on the above-mentioned website and placed on weekdays before 1:00 PM will be shipped the same day by Resort Finest. (During busy periods, a package may be shipped later, this is unfortunately beyond our control.) The customer must pay for the order in advance (iDeal or credit card) and provide a home address as the delivery address in one of the following countries: the Netherlands, Belgium, Germany, the UK, France, Austria, Italy, and Spain. Other countries are available upon request. Under certain circumstances, the delivery time can be up to 30 (thirty) days. The customer will be informed in advance.
  2. If an order placed on the above-mentioned website is paid by transfer, the delivery time is a maximum of 30 (thirty) days from the moment of payment.
  3. The customer is obliged to inform Resort Finest of any change of address. As long as Resort Finest has not received a notice of relocation, the customer is deemed to reside at the last address known to Resort Finest.

Method of Payment

  1. Resort Finest offers the possibility to pay via the internet. During the ordering process, the customer can authorize the payment method via the internet.

  1. Resort Finest takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment.

Contribution to Shipping Costs

  1. The customer pays a contribution to the shipping costs per order.

  1. For returns, €5.95 shipping costs will be charged in the Netherlands. This amount may vary per country. Resort Finest applies the shipping costs of that country, which are indicated by the delivery service DHL.
  2. Complaints about the execution of the agreement must be submitted to Resort Finest in a timely, complete, and clearly described manner, after the customer has discovered the defects.
  3. Complaints submitted to Resort Finest will be answered within a period of 14 (fourteen) days from the date of receipt. If a complaint requires a foreseeably longer processing time, Resort Finest will respond within the period of 14 (fourteen) days with a receipt notice and an indication of when the customer can expect a more detailed answer.
  4. Before resorting to the right of complaint, the customer must, at the request of Resort Finest, demonstrate that the agreement to which the complaint relates has been concluded with Resort Finest, by presenting the original purchase receipt or repair receipt or proof of order to repair or make the purchased item(s) and/or article(s).
  5. If there is a discount/advantage within 24 hours after your online purchases. Please report this in writing to the relevant customer service, mentioning your order number. At that moment, you are entitled to the offered discount/advantage.

Resort Finest records customer data for the execution of an agreement, the customer card program, and to inform about (new) products and/or services of Resort Finest and carefully selected partners. Resort Finest takes into account the wishes of the customer. If the customer does not appreciate information from Resort Finest or wishes to withdraw permission for the use of their email address, they can notify this in writing to: Resort Finest by email at klantenservice@resortfinest.com.

Resort Finest reserves the right to terminate the loyalty card program without giving any reason.


All agreements to which these terms and conditions are declared applicable are governed by Dutch law.


Changes to these general terms and conditions become effective only after they have been appropriately published, provided that the most favorable provision for the customer prevails in case of applicable changes during the duration of an offer.
